High Level Claw (gohighclaw.app)
Effective date: 2026-09-18
Last updated: 2026-09-23
Operated by: Open Claw Assistance LLC, a Wyoming limited liability company
This policy is part of the Terms of Service and applies to every Customer, Authorized User, Organization, and external agent that uses the Service. Capitalized terms have the meanings given in the Terms of Service. The SMS Messaging Terms and Consent add channel-specific rules for text messaging.
1. The principle
The Service sends real calls, texts, and emails to real people, publishes real websites and ads, and moves real money. Use it only for a lawful business you actually operate, only to reach people who expect to hear from that business, and only with content that is true. We enforce this policy to protect your Contacts, other Customers, our carrier and provider accounts, and the reputation of every business on the platform.
2. General prohibitions
You must not use the Service to:
- break any law, regulation, court order, or industry rule that applies to you;
- deceive, defraud, harass, threaten, stalk, or discriminate against anyone;
- impersonate any person, business, or government agency, or misrepresent who is calling, texting, emailing, or publishing;
- infringe copyright, trademark, patent, trade secret, privacy, or publicity rights;
- upload or distribute malware, phishing pages, or credential-harvesting forms;
- probe, scan, overload, reverse engineer, or interfere with the Service or its providers, or bypass rate limits, spend governors, approval gates, or tenant boundaries;
- access another Customer's Organization or data;
- resell, sublicense, or white-label the Service without a written agreement with us (Agency Plans may manage client Organizations under the Terms of Service);
- use the Service to build or train a competing product using our Output, templates, or prompts; or
- use the Service on behalf of a person or organization on a United States sanctions list.
3. Communications: calls, texts, and email
3.1 Consent comes first
You may contact a person through the Service only when you have the consent or other lawful basis that the channel and purpose require, and you must be able to prove it. Record the source, date, and wording of every consent in the Contact's consent ledger. Where the Service marks a Contact as opted out, no-consent, or do-not-disturb, you must not override that mark to send marketing.
3.2 Telephone Consumer Protection Act (TCPA) and telemarketing rules
- Prior express written consent is required before any marketing text or any marketing call that uses an artificial or prerecorded voice, an AI-generated voice, or an autodialer, to a mobile number. The FCC has confirmed that AI-generated voices are "artificial" voices under the TCPA. Outbound calls placed by the AI Receptionist or by an Automation are artificial-voice calls.
- Prior express consent (which may be oral or implied by the person giving you their number for that purpose) is required for informational texts and calls, such as appointment confirmations and reminders, order updates, and replies to a question the person asked.
- Do-not-call. Scrub marketing calls against the National Do Not Call Registry and applicable state registries, keep your own internal do-not-call list, and honor requests within the time the law requires. The Service's opt-out marks are part of your internal list, not a replacement for registry scrubbing.
- Calling hours. Marketing calls and texts may be sent only between 8:00 a.m. and 9:00 p.m. in the recipient's local time, or the narrower hours a state requires (for example Florida and Oklahoma). The Service's quiet-hours setting must not be set outside these limits.
- Identification. Every marketing call and text must identify your business. Every call must provide a working callback number.
- Missed-call text back, speed-to-lead, and review requests are texts. The first text to a new lead is lawful only when the lead gave you their number and consented to be texted, for example through a form or a call that disclosed texting. Configure those Playbooks accordingly.
- State laws. Several states (including Florida, Oklahoma, Washington, Maryland, and others) have their own mini-TCPA laws with stricter consent, hours, and frequency rules, and some (including Illinois, California, Florida, Pennsylvania, Washington, and Maryland) require all-party consent to record calls. You are responsible for the rules of every state your Contacts are in.
3.3 CTIA and carrier rules for messaging
All texting through the Service must follow the CTIA Messaging Principles and Best Practices and the SMS Messaging Terms and Consent. In short: get documented opt-in, honor STOP immediately, answer HELP, identify your business, keep message frequency to what you disclosed, never send the prohibited content in Section 5, and never buy, rent, or scrape phone numbers for texting.
3.4 Email
Email sent through the Service must comply with the CAN-SPAM Act and, where recipients are outside the United States, the laws that apply to them. Every marketing email must identify your business, include your physical postal address, include a working unsubscribe link, and use a truthful subject line and header. Honor unsubscribes within 10 business days; the Service honors them immediately. Do not send email to purchased or scraped lists.
3.5 Lead finder data
Leads produced by the Leads finder come from public business listings without any consent to receive marketing. You may research them, call them manually within telemarketing rules, or send them individually composed business email. You must not add them to automated texting or artificial-voice calling until you have obtained the consent the law requires.
4. AI-generated content and websites
- Truth. Do not publish Output that makes claims you cannot substantiate: results, guarantees, before-and-after outcomes, prices, credentials, licenses, awards, "as seen on", or comparisons with competitors.
- Reviews and testimonials. Do not generate, publish, or solicit fake reviews, testimonials, or endorsements. The FTC rule on consumer reviews and testimonials prohibits fabricated reviews, reviews by people who did not use the product, suppression of negative reviews, and undisclosed incentives. Review-request Playbooks must ask for honest reviews and must not condition an incentive on a positive review.
- Likeness and voice. Do not create video clones, voice clones, or avatars of any person without their written permission. Do not use My Video Clone or voice features to imitate public figures, competitors, or anyone who has not consented.
- Synthetic media disclosure. Keep AI disclosure labels where the law or a platform requires them, as the AI Disclosure and Fair Use Notice explains.
- Repurposing and Video Finder. Only repurpose video that you own or have a license to reuse. Video Finder locates public videos; finding a video does not grant you the right to reuse it.
- Regulated advice. Do not let AI features give medical, legal, financial, or insurance advice to Contacts unless you are licensed to give it and you review the content.
- Protected characteristics. Do not target, exclude, or price based on race, color, religion, national origin, sex, disability, familial status, age, or other protected characteristics, especially in housing, credit, employment, and insurance advertising.
- Website content. Tenant Sites must not host adult content, gambling, weapons sales, counterfeit goods, pirated content, hate speech, or content that exploits minors, and must carry the privacy notice and disclosures your trade requires.
5. Prohibited and restricted industries and content for messaging
Wireless carriers and The Campaign Registry reject or block messaging for certain content categories. Messaging through the Service is prohibited for:
- sex, adult content, and adult entertainment, including escort and "adult dating" services;
- hate speech, harassment, and content that promotes violence;
- alcohol, tobacco, vaping, and nicotine products where age gating is not enforced, and always for illegal sale;
- firearms, ammunition, and weapons sales;
- cannabis, CBD, kratom, and other substances that are federally illegal or federally unscheduled but restricted, regardless of state law;
- illegal drugs, prescription drugs without a valid prescription, and unapproved supplements or treatments;
- gambling, sweepstakes, lotteries, and casino promotion, unless separately approved in writing by us and by the carrier;
- high-risk financial services: payday loans, short-term high-interest loans, third-party debt collection, debt consolidation and relief, credit repair, tax relief, and cryptocurrency offers;
- "work from home", "get rich quick", multi-level marketing recruitment, and job offers that are not for a real position at your business;
- lead generation or affiliate marketing where the recipient's information is sold or the message promotes a third party;
- phishing, fraud, spoofing, and any message that hides or misrepresents the sender;
- political campaign messaging and fundraising, unless separately approved in writing; and
- emergency alerts or any message that could be mistaken for an alert from a government agency.
Messaging for the following is restricted and requires enhanced vetting, documented age or eligibility gating, and our written approval before your campaign is submitted: legal services, healthcare and pharmacy (subject to HIPAA rules that you must satisfy), insurance, mortgage and lending, real estate investing, and charity fundraising.
If your industry appears on either list, tell us before onboarding. Submitting a 10DLC campaign that hides a prohibited or restricted use case is a material breach.
6. Money, contracts, and payments
- Use Money and Stripe Connect only for goods and services your business actually provides, and follow the Stripe prohibited and restricted business lists.
- Do not use Claw Sign to obtain signatures by deception or on documents the signer has not had the chance to read, and do not send documents that require a notary or wet signature as if e-signature were sufficient.
- Do not use Automations to send invoices, contracts, or payment requests to people who have not agreed to do business with you.
7. Security and platform integrity
- Keep Customer Keys, API tokens, MCP tokens, and Authorized User credentials confidential, and rotate them if exposed.
- External agents that connect through MCP act under your Account. Do not connect agents you do not control or that you have not configured to respect approval gates.
- Do not use Automations, webhooks, or the assistant to attack, scrape, or overload third-party sites. Scan and webhook steps are limited to public internet addresses.
- Report vulnerabilities to support@openclawassistance.com. Do not exploit them or test against other Customers' data.
8. Monitoring and enforcement
We monitor aggregate signals such as opt-out rates, complaint rates, carrier filtering, delivery failures, and registry status, and we review content when we receive a complaint or a legal notice. We do not routinely read your messages. Depending on severity, we may warn you, require changes, pause a channel, throttle traffic, suspend Telecom Services, remove content, unpublish a Tenant Site, suspend an Organization, or terminate your Account, as the Terms of Service provide. Where a carrier, registry, or provider directs us to act, we act first and notify you after. We may share information about violations with carriers, The Campaign Registry, and law enforcement when required.
9. Reporting abuse
To report spam, unwanted calls, fraud, or abusive content coming from a business on the Service, email support@openclawassistance.com with the phone number, sender, date, and a copy of the message. Recipients can also reply STOP to any text to opt out immediately.
10. Changes
We may update this policy as laws, carrier rules, and the Service change. Material changes are announced in the Service or by email. Continued use after the effective date is acceptance.
